Motion to Quash Hearing - People vs. Christopher Schurr

A hearing on the motion to quash the second-degree murder charges against Christopher Schurr is scheduled for Friday, Feb. 3 at 8:45 a.m. before Judge Christina Elmore in the Kent County 17th Circuit Court. This is one of several motions before Judge Elmore on Friday.

On Jan. 9, 2023, attorneys for Christopher Schurr filed a motion to quash the district court’s finding that enough evidence was presented to send the case to trial.

Prosecutor Chris Becker filed a response on Jan. 24, 2023, requesting the motion be denied as the district court did not abuse its discretion in finding probable cause that a crime was committed and that Schurr committed that crime.

During Friday's hearing, Judge Elmore will decide to issue a written ruling at a later date or immediately rule on the motion to quash. Dependent on the decision, either side may file for leave to appeal the decision, which could delay the March 13, 2023 trial date.

Media Availability
At the conclusion of the hearing, there will be a media availability with Prosecutor Becker and defense attorneys. The event will be held in 5th Floor Conference Room. Credentialed media only. 

Defendant’s Attendance at the Hearing
Christopher Schurr will not be attending the hearing. As with all motions of this kind, the defendant is not required to be present for the hearing.
